The state already appealed the district court's Monday ruling, sending the case to the Fifth Circuit Court of Appeals. Texas is asking the Fifth Circuit court to temporarily reverse the decision by Tuesday night and move its hearing up to January.

In the motion for stay, the state argued the court took an "extraordinary step" in its ruling.

The court ruling on Monday struck down restrictions that required doctors performing abortions to have admitting privileges at local hospitals and partially struck down a ban on abortion medications.
